Abstract
This book addresses the topic of criminal protection of authors’ rights. The Algerian legislator places great importance on protecting authors’ rights, granting them a range of moral and material rights over their original works. This protection is regulated by several fundamental legal texts, most notably Ordinance No. 03-05 issued on 19 Jumada al-Ula 1424 AH (corresponding to July 19, 2003 CE) concerning authors’ rights and related rights, published in Official Gazette No. 44 of 2003 CE on July 23, 2003 CE. This ordinance aims to protect authors’ rights to their literary and artistic works, in addition to the rights of performing artists, producers of sound recordings, and broadcasting organizations. It is worth noting that intellectual property is divided into two categories: the first includes industrial property rights, which represent the legal protection of moral rights related to industrial and commercial innovations and inventions. Industrial property rights include moral rights related to patents, utility models, integrated circuit designs, undisclosed information, trademarks and trade names, geographical indications, industrial designs and models, and plant varieties. Literary property rights include the rights of authors to their works and the means of legal protection thereof in the fields of science, art, and literature, whether written (such as books, speeches, and articles) or unwritten (such as theatrical, musical, and cinematic works); computers; databases (whether computer-readable or not); architectural works; drawings, calligraphy, paintings, sculptures, lithographs, and textiles; photographic and similar works; applied and plastic arts works, illustrations, geographical maps, plans, and derivative works.
