ملخص:

منذ استقلاله، انخرط المغرب في عملية طويلة من اللامركزية تهدف إلى تعزيز الديمقراطية والمساءلة والقرب في إدارة الشؤون المحلية. وبفضل الإصلاحات المتتالية، تم تعزيز صلاحيات ومسؤوليات الجماعات الترابية بشكل كبير، إلا أن اختصاصاتها في المجال الصحي تبقى هامشية. في السياق الحالي الذي يتسم بإعطاء الأولوية للسياسات الصحية وتوسيع الحماية الاجتماعية، تعد مشاركة هده الجماعات في هذه الجهود ضرورية لاسيما عبر تمويل مناسب.
من خلال تحليل الإطار القانوني واستحضار بعض التجارب الأجنبية، يهدف هذا المقال إلى استكشاف الطرق التي يمكن من خلالها للجماعات الترابية المساهمة بشكل أفضل في تحسين تقديم الرعاية الصحية والتنفيذ الفعّال للحق في الصحة.

Résumé 

Depuis son indépendance, le Maroc s’est engagé dans un long processus de décentralisation visant la démocratisation, la responsabilisation et la proximité dans la gestion des affaires locales. Grace à des réformes successives, le statut et les responsabilités des collectivités territoriales se sont considérablement renforcés. Toutefois, leurs compétences en matière de santé demeurent marginales. Dans le contexte actuel marqué par la priorisation des politiques de santé et la généralisation de la protection sociale, les collectivités territoriales doivent, à travers un financement adéquat, participer activement à ces efforts.

En analysant le cadre juridique et en invoquant certaines expériences étrangères, cet article a pour objet d’explorer les outils permettant aux collectivités territoriales de mieux contribuer à l’amélioration de l’offre de soins et à la mise en œuvre effective du droit à la santé.

What is the role of local authorities in financing healthcare in Morocco? A legal and comparative study

Abstract

Since its independence, Morocco has engaged in a long process of decentralization aimed at democratization, accountability, and proximity in the management of local affairs. Thanks to successive reforms, the status and responsibilities of the territorial communities have been considerably strengthened, however, their health competences remain marginal. In the current context marked by the prioritization of health policies and the generalization of social protection, this communities must actively participate in these efforts through adequate funding.

By analysing the legal framework, and invoking certain foreign experiences, the purpose of this article is to explore the ways by which the territorial communities can better contribute to the improvement of healthcare provision and the effective implementation of the right to health.
